Southridge Solutions (SRS) Web Hosting Terms of Service (TOS)
This version of the SRS Web Hosting TOS is valid
from 13 April 2006 until replaced.
Use of Southridge Solutions’ Service constitutes acceptance of,
and agreement to, our TOS (Terms of Service).
Southridge Solutions reserves the right to revise, amend, or modify this
TOS (Terms of Service) and our other policies and agreements at any time
and in any manner. Notice of any revision, amendment, or modification
will be posted in accordance with our TOS (Terms of Service). All users
of Southridge Solutions' services, and their clients, must comply with
the TOS (Terms of Service).
1. Client agrees that by placing an order either by means of electronic
ordering or submitting a written contract, and receipt of such order by
Southridge Solutions, that you are agreeing to our TOS. No Modifications
of said contract by customer is allowed.
2. Southridge Solutions will provide, and Customer will purchase and pay
for, the Services, and service fees specified. Customer acknowledges that
the service, and service fees have been communicated to the customer,
and that they are aware of all applicable charges as per contract, TOS.
Customer also understands that any promotional offers unless specified
in contractual terms will not be applicable to their individual service.
3. In connection with any Hosting Services, if Customer’s actual
bandwidth usage in any month exceeds allotted amount, specified in Customer’s
contract, Customer will pay Southridge Solutions any additional fees as
specified in the Service Description.
Terms and Conditions
1) I agree to send payment to Southridge Solutions promptly upon notification.
We will email you your username and password within 10 working days. After
we do so, we will email you your bill.
2) I am 18 years of age or older.
3) All the information provided is true.
4) If I place pornographic content on my site or if I make any attempts
to hack into the server, I agree to accept any appropriate action that
Southridge Solutions may take against me. For example: Deactivation of
my account without prior notice and a full investigation. In severe cases
the proper authorities will be informed.
5) The right to refuse a new customer or cancel an existing customer's
account without notice, shall be at the sole discretion of Southridge
Solutions. We do not have to give notice of cancellation, if it will occur.
No backups will be supplied for deleted accounts.
6) Under no circumstances shall Southridge Solutions be liable for any
direct, indirect, special, punitive, or consequential damages that result
in any way from your use of or inability to use the service, or for third
parties' use of the service to access your Web space, or to access the
Internet or any part thereof, or your or any third parties' reliance on
or use of information, services, or merchandise provided on or through
the service, or that result from mistakes, omissions, interruptions, deletion
of files, errors, defects, delays in operation or transmission, or any
failure of performance. If you are dissatisfied with Southridge Solutions
service or any of its terms, conditions, rules, policies, guidelines,
or practices, your sole and exclusive remedy is to discontinue using the
service.
7) Southridge Solutions provides no guarantee that the service will be
uninterrupted or error free, but we will do our best to prevent this from
happening and we will also do our best to make the necessary repairs/modifications
to get the service up and running as quickly as possible. Where possible
we will notify you of any scheduled downtime via our website.
8) My use of the service is at my sole risk. Southridge Solutions is not
responsible for files and data residing on my account. I agree to take
full responsibility for files and data transferred and to maintain all
appropriate backup of files and data stored on Southridge Solutions servers.
I also take full responsibility for the misuse of my account for unlawful
purposes. For example: Spamming, Junk/Bulk E-mailing, Hacking, etc.
9) By agreeing with the Terms and Conditions I realize that it is as good
as placing my signature on a physical order form.
10) Any account that is more than 7 days past due will be temporarily
suspended until payment has been received. After 30 days without payment,
an account will be deleted. A late fee of $1.00 per day will be added
to all accounts 14 days past due.
11) No illegal or controversial material allowed on the server whatsoever.
We reserve the right to terminate any account violating our terms.
12) NO SPAM - NO WAREZ - NO PORN - NO ADULT - NO MP3 - NO over 18 TO ENTER
- NO GAMING/GAMBLING - NO HATE AGAINST ANY GROUP, PARTICULARLY BASED UPON
RELIGION, RACE, GENDER, SEXUALITY, NATIONALITY, OR AGE
13) NO Shoutcast Streaming MP3 Servers are to be installed on our web
servers.
14) We will not notify customers of any changes to our TOS via our website,
by listing the last date at which the TOS was modified, on the link to
the TOS, and within the TOS.
15) In addition, when using particular services, you shall be subject
to any posted guidelines or rules applicable to such services which may
be posted from time to time. All such guidelines or rules are hereby incorporated
by reference into the TOS.
